Judge weighs fate of Trump order as DOJ appeals to Supreme Court

Justice Ketanji Brown Jackson has given pro-voting challengers until Tuesday, Sept. 8, to respond to the Trump administration’s emergency request to lift Talwani’s temporary block on USPS’ new mail voting rule.

The administration asked the Supreme Court for both a stay and an immediate administrative stay while its appeal proceeds. Jackson, who handles emergency matters arising from the 1st Circuit, has not yet granted that request.

The briefing schedule comes as Talwani is separately weighing whether to issue a preliminary injunction after Thursday morning’s hearing — a ruling she has said she intends to issue as quickly as possible.
